Article 101: Prosecution Requirements 1. Reasonable Suspicion - Circumstantial facts that may lead one to believe the crime has been committed, but does not directly link the accused to the crime. Doubt can be established. 1.1 An individual under reasonable suspicion, or detained for questioning may be "Terry Frisked" for weapons for the officer's safety (Refer: Terry V. Ohio). If unlawful possession of a weapon is discovered, it is probable cause for a full search. 2. Probable Cause - Reasonable belief, based on facts that can be articulated, that a particular person has committed a crime, especially to justify make a search or pressing charges. 2.1 An individual that meets probable cause standards may be fully searched. 3. Evidence is constituted by video or stream from the perspective of someone other than the accused. Material evidence such as contraband, weapons, or vehicles. Credible witness statements from several different persons that directly witnessed the situation. 4. Probable cause with direct witness or video evidence for each charge is necessary to prosecute a civilian. 5. Wearing a mask constitutes Probable Cause for Search. A helmet constitutes is a mask if it obscures your face, unless currently operating a motorcycle. 6. Warrant - If someone has a warrant out for their arrest, regardless of what they are doing, you can detain and arrest them. 7. Being in a processing/gathering area (ie: circle / area where the circles can be) for illegal drugs or endangered animal remains is probable cause for Manufacturing & Cultivation or Manufacturing of Endangered Animal Products. 7.1 Being on a property where illegal narcotics or endangered animal remains are manufcatured is reasonable suspicion for questioning and frisk. 8. Marijuana is legal up to 14 units, but cultivating and manufacturing is illegal without a business license 9. Actively hunting constitutes probable cause for search. 10. Chicken Hawks, Chimpanzees, and Mountain Lions are all considered endangered species. 11. Entrapment - Based on the interaction between police and the defendant prior to or during the alleged crime. There is the expectation for ordinary people to resist any and all temptation to violate the law. Entrapment is when police officers resort to the use of threats, harassment, fraud, flattery, commands, etc. in order to induce a person to commit a crime. Example: Use of a “bait car” in order to catch individuals stealing. Merely placing the bait car and watching it is not entrapment. Bait cars merely offer the opportunity of stealing a car. Entrapment would be if the officer pointed out the car or mentioned the car, and then the defendant steals it after the officer leaves. 11.1 Any charges against a person obtained through entrapment is cause for the charges to be nullified. 12. All persons handcuffed have the right to know why they have cuffed after they have been cuffed. 13. Open carry of a sidearm is legal with a valid Pistol license as per direct order from the Governor. 15. Self Defense - Must not have been initator or original aggressor AND must reasonably believe that they were in imminent danger of being killed or suffering great bodily injury, or was in imminent danger of being severly harmed, AND the indidiviaul reasonably believed that the immediate use of deadly force was necessary to defend against that danger; AND The defendant used no more force than necessary to defend against that danger. 16. Warrants shall be disclosed upon request to any individual unless said warrant is sealed. Aggravated Felony and Search Warrants are automatically sealed. 17. When a law enforcement officer is pursuing a fleeing suspect, the officer may not use deadly force to prevent escape unless the officer has probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others. (Refer: Tennessee V. Garner) 18. Storage units found upon the property of known drug / narcotic manufacturing locations, or Government owned property without permission, shall be automatically removed / seized.. |
